Terms and Conditions
IMPORTANT. These Terms and Conditions cover the event to be held the weekend of September 18/19th 2010. Please read them carefully prior to registering for the event. You should only register and enter the event if you have read, understood and agreed with these conditions. These conditions represent a legally binding agreement between you and My Triathlon Limited.

My Triathlon Ltd Terms and Conditions

1. Terms

1.1 Entrant:- Person named on entry form
1.2 Entry Form:- Web or postal entry form
1.3 Event:- Tatton Park Triathlon
1.4 Organiser:- My Triathlon Limited (Registration No. 0606522)
1.5 Organisers Office & Registered Office:- My Triathlon Ltd, 3 Albion Grove, Sale, Manchester, M33 7TJ.
1.6 Fee:- Price detailed on the entry form including discounts or promotional offers.
1.7 Entry Credit:- A credit for entry to the next running of the event.

2. Acceptance of Terms and Conditions

2.1 The Person named on the entry form (“the entrant”; “you”) by entering the event by online at www.tattontriathlon.co.uk.entry form or downloaded postal entry agrees to abide by the Terms & Conditions.
2.2 The terms and conditions do not exclude the organiser’s liability for any matter which it would be illegal for the organiser to exclude (see 8.1).
2.3 The terms and conditions do not affect your statutory rights (see 8.1).

3. Limit of Liability

3.1 The Organiser shall not be liable for any loss, death, injury or damage however caused to any person or property, except where such loss, death, injury or damage is a result of the negligent acts or omissions of the organiser. Any claim to which legal liability is established shall not include damages for indirect or consequential loss.

4. Entrant

4.1 The entrant is eligible to participate in the event when the full fee has been received by the organiser as cleared funds.
4.2 You certify that you are 18 or older or you are the parent/guardian of a child under the age of 18 and have read these conditions and accept the terms and conditions it contains.
4.3 The event is run under Triathlon England Rules and Regulations and the entrant agrees that they will compete under these rules. The rules and regulations are available from http://www.britishtriathlon.org/uploads/files/Technical%20Rules%202006.pdf"
4.4 You agree and acknowledge that you are aware that a competitive triathlon involves the real risk of serious injury or even death from various causes including exertion, strenuous activity, equipment failure, dehydration, collisions, or incidents involving competitors, spectators, other road users and/or vehicles, aspects of the course or bad weather conditions and other causes. You understand that you should not enter or participate in the event unless you have trained appropriately and had any health concerns checked by a medical practitioner. If you have any family health issues or have any concerns you should seek clearance from your general practicioner and we recommend if it is your first triathlon that you seek clearance before entering the race.
4.5 You acknowledge that participation in the event will be physically demanding and you are aware of the nature of the event and the associated medical and physical risks involved. You accept that you are physically capable of competing in the event and agree that, subject to the limitation of liability paragraph below, My Triathlon, its officers, agents, affiliates, sponsors or medical advisers are not responsible for any injury or illness that you may suffer as a result of your participation in the event. The entrant accepts that should any medical or physical condition arise prior to the event which is likely to affect their ability to compete then the entrant will withdraw in accordance with these terms and conditions.

5. Entrant Withdrawl & Refund Policy

5.1 The fee is for the event stated on the entry form and entry to another event is only possible by the issue of an entry credit from the organiser.
5.2 Entrants who are members of Triathlon England, Welsh Triathlon or Triathlon Scotland will provide valid membership cards at registration to receive their refund.
5.3 If the entrant wishes to withdraw from the event the entitlement for a refund or entry into the following year’s event (“entry credit”) is detailed below:-

After entry to the race is closed the entrant will receive no refund or entry credit
If entry to the race is open then 180 or more days before the event the entrant is entitled to a full fee refund less an admin charge of £15
If entry to the race is open 179-60 days before the event the entrant is entitled to an entry credit to the next event upon written request and subject to an admin charge of £15.
If entry to the race is open 60 days or less before the event the entrant will receive no refund or entry credit whatever the reason (including medical). If the entrant wishes to claim a refund or entry credit they must send a written request in writing with a stamped address envelope and cheque to My Triathlon Ltd, 3 Albion Grove, Sale, Manchester M33 7TJ.
The effective date for cancellation is the date of receipt by the organiser of the entrant’s cancellation letter.


5.4 If the entrant fails to attend the event they are not entitled to any refund or entry credit.
5.5 The entry to the race is not transferable to another individual.
5.6 Any change in race distance will incur an admin charge of £15. No change will be made until we have cleared funds. No changes can be made 30 days or less before the event.
5.7 Any refunds for whatever reason will incur an admin fee of £15.

6. Event Cancellation or Alteration

6.1 The organiser reserves the right to alter the date of the event. If the entrant wishes a full fee refund they must write to the organiser’s office (see 1.5) within 30 days from the date of notification of the event date change.
6.2 The organiser reserves the right to alter the format of the event and in such a case the entrant is not entitled to a fee refund or an entry credit. You consent to such changes and you agree that every condition set out here applies to the changed event. One example of such a change could be if extreme weather means that the swim could not take place for safety reasons in which case the event would change to a Duathlon (Bike and Run).
6.3 The organiser reserves the right to implement cut off times for the completion of the swim, bike and run sections to ensure the safe running of the event. If an entrant is removed from one section they will be allowed to continue the next section subject to cut off times.
6.4 The organiser can invoke force majeure should the reason be partly or fully the result of extreme weather, war, mobilisation, riots, flooding, fire, accidents, strikes, occupations, measures set by the national or local government, epidemic, non-delivery by third parties and other unforeseen events. The organiser will issue a refund net of any costs incurred to the date of cancellation.
6.5 The organiser reserves the right to cancel the event for other reasons than in 6.4 and the organiser will issue a refund to the entrant net of costs incurred to date of cancellation.

7. General

7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
7.2 If any provision of these Terms and Conditions is found to be invalid by any court having jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
